A Firm Stance for North West Consumers

The North West Department of Economic Development, Environment, Conservation and Tourism (DEDECT), through its Consumer Affairs Court (CAC), has issued a landmark ruling, ordering two suppliers to refund a consumer R130 000 with interest for undelivered building materials. This decision underscores DEDECT's unwavering commitment to upholding the Consumer Protection Act (CPA).

The case involved Tshegofatso Galeboe, who paid for materials from Suite Designers 157 and Ranz Trading Enterprise, but received nothing. The court found both suppliers in contravention of Consumer Protection Act Sections 19 and 68, which mandate timely delivery of goods free of defects.

The ruling orders refunds of R50 000 and R80 000 respectively, payable within 30 days, plus 6.5 percent interest.
"This case shows that the rights of consumers must be respected.aSuppliers cannot delay deliveries, change agreements without consent, or punish consumers for cancelling contracts based on non-performance," CAC Chairperson Kennedy Kgomongwe said after the ruling.

This judgment sends a clear message to all businesses in the North West: consumer rights are paramount, and violations will face legal repercussions. For consumers, it reinforces trust in the system, providing a robust avenue for redress against unfair business practices and fostering a more ethical marketplace.
